These Terms of Service ("Terms") govern your use of the Uniqum messaging platform and related services ("Service") operated by Bytebit LTD ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using Uniqum, you represent that you meet this age requirement. If you are under the age of legal majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

• You must provide a valid phone number to register. Verification is performed via a one-time code sent through WhatsApp.
• You are responsible for maintaining the security of your account and devices.
• You may not create accounts for the purpose of spam, abuse, or impersonation.
• One account per phone number. Duplicate accounts may be terminated.

3. Acceptable Use

You agree not to use the Service to:

• Send spam, bulk unsolicited messages, or automated messages without consent.
• Distribute malware, viruses, or any harmful software.
• Harass, threaten, or abuse other users.
• Share content that is illegal, defamatory, or infringes on the rights of others.
• Distribute child sexual abuse material (CSAM) or exploit minors in any way.
• Impersonate another person or entity.
• Attempt to reverse-engineer, decompile, or exploit the Service infrastructure.
• Circumvent rate limits, security measures, or access controls.
• Use the Service for any activity that violates applicable laws or regulations.

4. User Content

You retain ownership of the content you send through the Service. By using Uniqum, you grant us a limited license to transmit, store, and deliver your content solely for the purpose of operating the Service.

• End-to-end encrypted messages cannot be accessed or read by us.
• We do not claim ownership over your messages, media, or files.
• You are solely responsible for the content you share.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

6. End-to-End Encryption

Private messages on Uniqum are protected by end-to-end encryption using the Signal Protocol. This means:

• Only you and the intended recipient can read your messages.
• We cannot decrypt, read, or monitor the content of encrypted messages.
• Encryption keys are generated and stored on your device.

7. Service Availability

• We strive to keep the Service available at all times but do not guarantee uninterrupted access.
• We may perform maintenance, updates, or modifications that temporarily affect availability.
• We are not liable for any loss or damage resulting from service interruptions.

8. Account Termination

• By you: You may delete your account at any time through the app settings or by contacting us at privacy@buzzberry.net. See our Data Deletion Instructions for details.
• By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will make reasonable efforts to notify you before termination, except in cases of severe abuse.

9. Intellectual Property

The Service, including its design, code, features, and branding, is the intellectual property of Bytebit LTD. You may not copy, modify, distribute, or create derivative works based on our Service without prior written permission.

10. Third-Party Services

The Service may integrate with or link to third-party services (e.g., WhatsApp for verification). We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is governed by their respective terms and policies.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

12. Limitation of Liability

To the maximum extent permitted by law, Bytebit LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.

13. Indemnification

You agree to indemnify and hold harmless Bytebit LTD, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The "Last updated" date at the top indicates the most recent revision.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Bytebit LTD is incorporated. Any disputes arising from these Terms shall be resolved in the competent courts of that jurisdiction.
